When a conviction depends largely on the victim’s testimony, the courts turn to a set of established parameters to assess its credibility: the so-called “triple test”. It is worth knowing it, but also understanding its limits.

The three classic elements

The triple test requires analysing: (1) the absence of subjective incredibility, that is, the absence of spurious motives (resentment, revenge, enmity, self-interest) that would deprive the statement of its capacity to generate certainty; (2) the plausibility, supported where possible by objective peripheral corroboration; and (3) the persistence of the incrimination, sustained over time and free of relevant contradictions.

Corroboration is not always required

In offences committed in private there may be no peripheral corroboration. The Supreme Court makes clear that such corroboration must not be demanded at any cost: it may be absent, weak or unnecessary. What is decisive is whether the court concludes that the account is credible, reliable and truthful.

“Demystifying” the triple test

The Supreme Court itself has warned that these three requirements are neither a fixed standard of proof nor the only factors to be considered. The assessment of witness evidence is more complex and cannot be mechanically simplified (STS 679/2022 of 5 July and STS 299/2024 of 9 April). The triple test is a guide, not an automatic checklist.

Practical consequence

For the defence, it is not enough to invoke the triple test in the abstract: the spurious motive, the lack of plausibility or the core contradictions that erode persistence must be demonstrated in the specific case. For the prosecution, the absence of corroboration does not, by itself, prevent a well-reasoned conviction.
