Article 454 of the Spanish Criminal Code: family exemption from liability for harbouring an offender

Wording of the provision

Exempt from the penalties imposed on those who harbour offenders are persons who do so in respect of their spouse or of a person to whom they are stably bound by a comparable relationship of affection, of their ascendants, descendants, siblings, whether by birth or adoption, or relatives by affinity in the same degrees, with the sole exception of those falling within the case of number 1 of article 451.

Elements and scope

  1. Prior commission of conduct amounting to harbouring under article 451, in any of its forms, with knowledge of the offence and without having taken part in it as principal or accessory.
  2. The presence of one of the exhaustively listed ties, which case law construes strictly since the list is closed.
  3. Stability of the relationship comparable to marriage, to be established by cohabitation, registration of residence, common children or equivalent indications.
  4. Express exclusion of the case of article 451.1, which punishes a person who assists the principal or accessory in profiting from the proceeds, product or price of the offence.
  5. The personal nature of the excuse, which is not transmitted to participants not bound by the tie, under article 65.

Points of application

Strict construction of the list of relatives. The Second Chamber of the Supreme Court does not allow the list to be extended by analogy. Uncles, nephews and cousins fall outside it, as do relationships of close friendship however intimate.
Proof of a relationship comparable to marriage. The requirement of stability prevents the excuse from applying to occasional relationships. Case law looks to cohabitation, its duration and the outward appearance of the relationship, without requiring registration.
Scope of the article 451.1 exception. The exclusion affects a person acting for his own or another’s gain in respect of the proceeds of the offence. The rationale of the excuse, family solidarity, falls away where the relative seeks financial benefit.
Relationship with the exemption under article 416 of the Criminal Procedure Act. These are distinct institutions: the absolutory excuse operates on the criminal liability of the person harbouring, whereas the exemption relieves a witness of the duty to testify. The reform introduced by Organic Act 8/2021 narrowed the scope of that exemption.
Effects on civil liability. Exemption from punishment does not extinguish civil liability arising from the offence harboured where the person concerned has caused a separate loss, a question to be examined under articles 116 and following.

Defence strategy

Establish the family tie by documentary evidence. The family record book, registry certificates, a joint certificate of residence and documentation of the civil partnership are the strongest evidential basis.

Prove the stability of the partnership. Where there is no marriage, cohabitation should be established through tenancy agreements, joint accounts, witness evidence and documentation concerning common children.

Rule out a profit motive. The decisive line against the article 451.1 exception is to show that the conduct was aimed at protecting the relative and not at obtaining financial benefit.

Dispute the classification as harbouring. It must be examined whether the conduct truly amounts to harbouring or rises to joint principalship or complicity, in which case the excuse does not apply.

Invoke the personal nature of the excuse. Where several persons harboured the offender, each position must be distinguished, since the exemption is not transmitted under article 65.
