Article 451 punishes whoever, knowing of the commission of an offence and without having taken part in it, intervenes after its execution by assisting the offenders to profit from it, by concealing the evidence or by helping them to evade the investigation.
Whoever, with knowledge of the commission of an offence and without having taken part in it as perpetrator or accomplice, intervenes after its execution in any of the following ways shall be punished with imprisonment of six months to three years:
1. By assisting the perpetrators or accomplices to benefit from the profit, product or price of the offence, without intent to gain personally.
2. By concealing, altering or rendering unusable the body, the effects or the instruments of an offence, in order to prevent its discovery.
3. By helping the persons alleged to be responsible for an offence to evade the investigation of the authority or of its agents, or to escape their search or apprehension, provided that any of the following circumstances is present:
a) That the offence covered up constitutes treason, homicide of the King or of the Queen or of any of their ascendants or descendants, of the Queen consort or of the consort of the Queen, of the Regent or of a member of the Regency, or of the Prince or of the Princess of Asturias, genocide, a crime against humanity, an offence against persons and property protected in the event of armed conflict, rebellion, terrorism, homicide, piracy, trafficking in human beings or unlawful trafficking in organs.
b) That the person giving assistance has acted with abuse of public functions. In this case there shall be imposed, in addition to the custodial penalty, special disqualification from public employment or office for a term of two to four years if the offence covered up was a less serious one, and absolute disqualification for a term of six to twelve years if it was a serious one.

Knowledge of the offence. The offence requires knowledge of the commission of the prior offence. A generic suspicion, or knowledge acquired after the assistance was given, does not satisfy the subjective element, which cannot be inferred from the mere relationship between the parties.
Excuse for relatives. Article 454 exempts from punishment whoever covers up a spouse, a person in an analogous relationship of affection or certain relatives, save in the case of number 1. That excuse is habitually decisive and must be raised at the outset.
Distinction from handling stolen goods. Where the accused acted with intent to gain personally, the conduct falls under Article 298, which has its own frame and its own ceiling. Identifying the presence or absence of that intent determines the applicable provision.
Restrictive list of number 3. Helping a person to evade the investigation is punishable only where the offence covered up appears in the list of subparagraph (a) or where public functions were abused. Outside those cases the conduct is not criminal, which is habitually overlooked.
