I have been reported for gender violence. What happens now?

The procedure is very fast: arrest or immediate summons, a specialised court and a possible protection order within 72 hours. Do not testify without a lawyer; the first decisions condition the whole case.

What are the penalties for drug trafficking?

From 1 to 6 years for the basic offence depending on the substance, with aggravated forms for notoriously large quantities or organisation. The defence turns on the lawfulness of the intervention: searches, controlled deliveries and the chain of custody of the substance.

What cases does the Audiencia Nacional hear?

Large-scale cases: organised crime, major economic fraud, international money laundering or terrorism. They are long, documentally massive proceedings that demand an analysis method such as LIWARD.

What is the third-degree (open) prison regime and how is it applied for?

The semi-liberty regime. It is applied for before the Prison Administration and appealed before the Prison Supervision Court. We work on classifications, progressions of degree, prison leave and conditional release.

Can I be extradited or surrendered under a European arrest warrant?

The European arrest warrant has strictly defined grounds for refusal (sentences in absentia, fundamental rights, non bis in idem). With a presence in London and Paris, we coordinate defences with an international dimension.

I have tested positive in a breathalyser check. What can happen to me?

From 0.60 mg/l in exhaled air (or driving under the influence of drugs) it is a criminal offence, not a fine: it is usually processed as a fast-track trial with fines, community work and disqualification from driving for 1 to 4 years. There is room for defence in the breathalyser’s margin of error and in the procedure.

Are robbery and theft the same thing?

No: theft is taking someone else’s property; robbery adds force on things or violence and intimidation, with far higher penalties. Below 400 euros, theft is a minor offence.

What is prison leave and when can it be requested?

Ordinary leave of up to 7 days once a quarter of the sentence has been served in the second degree, with good progress. Refusals are appealed before the Prison Supervision Court.

What is a pardon and how is it applied for?

A measure of clemency by the Government that extinguishes the sentence in whole or in part. It is processed through a reasoned file (community ties, reparation, delays); we also prepare the suspension of the sentence while it is decided.
