Table 1.A of the 2026 scale. It calculates the basic compensation of each injured party. It does not include the particular harms of table 1.B nor the loss of earnings of table 1.C.
The damage assessment system of Act 35/2015 distinguishes three main heads of compensation, each with its own tables. The temporary injuries head compensates the period running from the accident until the injuries stabilise, with four degrees of intensity and an additional sum for each surgical operation. The sequelae head compensates the harm that remains once the injuries have stabilised, assessed in points by a forensic physician or an expert and cross-referenced with the age of the injured party: the younger the person, the higher the compensation, because the harm will accompany the victim for longer. The death head affords compensation to each category of injured party, with the particularity that the categories are not mutually exclusive.
The amounts are updated every 1 January in accordance with article 49.1 of the consolidated text of the Act on civil liability and insurance in the circulation of motor vehicles. For 2026 the update was 2.9 %, corresponding to the variation in the consumer price index for 2025 published by the National Statistics Institute, and it is set out in the DGSFP Resolution of 3 February 2026.
Three practical cautions should be borne in mind. First: where several sequelae concur, their points are not added arithmetically; the formula of article 98 applies instead. Second: aesthetic harm is assessed autonomously and added to the psychophysical harm. Third: the reasoned offer sent by the insurer is usually below the valuation resulting from an opposing expert report, so that accepting the first proposal is rarely the best decision.
