This table sets out the abstract penalty that the Criminal Code assigns to each offence: the framework from which the court starts before applying degrees, mitigating and aggravating circumstances. The final sentence may be much lower (or higher) depending on the circumstances: see how it is calculated in our guide on sentencing determination and what reduces it under mitigating circumstances and suspended sentences. Updated to Organic Law 1/2026 on repeat offending, which toughened penalties for repeated minor theft and fraud.
Table prepared by SCJE from the text in force of the Spanish Criminal Code (Organic Law 10/1995) with the reforms up to Organic Law 1/2026. It does not replace individual advice: the penalty applicable to a specific case depends on the degree of completion, the form of participation and the concurrent circumstances.
