24-hour criminal defenceEnglish-speaking criminal lawyer in Denia

Criminal defence in Denia and the Marina Alta for English-speaking clients. Arrests, driving offences and property matters.

Criminal defence in Denia, in English

Denia and the Marina Alta combine a settled international community with a strong seasonal influx. The result is a mix of driving offences, incidents arising from nightlife, and property crime affecting second homes.

Cases arising in Denia are dealt with by the courts of the Alicante judicial district, where we are based. That proximity matters: it means being at the police station or before the judge the same day, reading the file in time, and setting the strategy before the investigation hardens in a direction that is difficult to reverse.

What we are usually called about

  • Drink driving and refusing the breath test, the single most common charge among foreign residents and visitors. See drink driving.
  • Assault after a night out, which escalates faster than people expect. See assault.
  • Theft and burglary, both defending and acting for owners of holiday homes.
  • Squatters in properties left empty out of season. See squatters.
  • Online and bank fraud targeting residents. See cybercrime.
  • Drug offences. See drug offences.

If you have been arrested

You have the right to remain silent, to an interpreter, and to choose your own lawyer instead of the duty solicitor. Exercise that last right: the duty lawyer meets your file minutes before your interview.

Denia and the Marina Alta

Denia combines a settled international community with a strong seasonal influx, and a marina. That mix produces its own caseload: driving offences after evenings out, disputes in the nightlife district that escalate into assault charges, property crime affecting second homes in Jávea, Moraira and the surrounding urbanisations, and matters connected with boats and moorings, where ownership, chartering and customs questions can turn criminal faster than owners expect.

Cases from Denia are dealt with by the courts of the Denia judicial district, and the practical rhythm there is not the same as in Alicante. Knowing that difference is part of the job.

The charge most people get wrong

A positive breath test above 0.60 mg/l is a crime in Spain, not a fine, and refusing the test is a separate and heavier offence. People who would never consider themselves criminals are prosecuted every summer for exactly this. See drink driving.

These cases go to a fast-track hearing within days, where you will be pushed to plead guilty on the spot. Sometimes that is right. But not before someone has checked whether the breathalyser was properly calibrated and whether you were offered the blood test you were entitled to.

If you have been arrested

Up to 72 hours in custody. Right to silence, free interpreter, medical examination, consular notification, and the right to choose your own lawyer instead of the duty solicitor. Exercise it: the duty lawyer receives your file minutes before your interview.

24-hour emergencies. Fixed fees, agreed in writing before we act. See our fees.

Frequently asked questions

I was over the limit but I was barely moving the car in a car park. Does that count? Driving is driving, including manoeuvring. But the circumstances matter for the sentence, and whether you were actually in control of the vehicle is sometimes genuinely arguable.

My case is in Denia, not Alicante. Does that change anything? It changes the court, the timescales and the practical dynamics. It is worth having someone who works there rather than someone who has only read about it.

Something has happened involving my boat. Is that criminal? It can be. Questions of ownership, chartering without a licence, and customs matters cross into criminal law faster than owners expect, and they are handled by specialised units.

Do I need to attend every hearing? Not always. In many stages we can represent you without your presence.
